Another farm group is now part the lawsuit to overturn the EPA Army Corps Waters of the U.S. regulation. The National Corn Growers joined with 13 other groups, including the American Farm Bureau, against the rule.
Ethan Matthews with NCGA says there are jurisdictional and constitutional problems with the new rule, but courts may be slower than Congress in helping out. He adds it's also difficult for a legislative fix. He adds the longer there's no judicial or legislative relief, producers are more likely to be affected.
In the meantime, a federal Appeals Court upheld EPA's limits on pollutants in the Chesapeake Bay, which can be seen as a future model.
